Chronic Fatigue Syndrome Claim Challenges

Claims based on Chronic Fatigue Syndrome or Fibromyalgia are often very difficult to achieve success.

I have experience with these claims for many years. I worked on the Chronic Fatigue Syndrome Advisory Committee in Washington, part of the Health and Human Services and a number of other medical resources to improve the lives of claimants with Chronic Fatigue Syndrome. After that experience it became a focus of our practice. We work with a number of clients to secure their benefits in these types of claims.

The way in which we have success with these claims is with a two-pronged approach. We typically have our clients go for Cardiopulmonary Exercise Testing, CPET,  objective testing that will document their functionality, their deficits, their oxygen,  and how they are able to  output their energy

The data from the CPET testing is often utilized to demonstrate that someone who does not have the energy output to even function  barely for their activities of daily living, let alone their job. That evidence is powerful.

In addition, we often get neuropsychological testing, which may demonstrate functional deficits in various domains – memory or executive functioning or other types of testing results may be revealed which we can then demonstrate is evidence of their inability to perform their occupational duties.

With these two tools, we achieve success for our clients with these types of claims.

That evidence will allow us to tie in their functional deficits for their occupational requirements and provide the support that is needed to overcome the insurance company’s typical approach to not want to accept claims for Chronic Fatigue Syndrome.
